ABOLITION OF BONDED LABOUR SYSTEM

Rehabilitation of  Bonded Labour

The practice of bonded labour is banned under of Articles 21 & 23 of the Constitution of India and therefore the Government of India has enacted the Bonded Labour System (Abolition) Act of 1976.

            Bonded Labour System means the system of forced or partly forced labour either without wages or for nominal wages.  Under this system, the labour forfeit the freedom of movement from one employer to another or other means of livelihood and thus the person forfeit the right to move freely throughout the territory of India.

            As per Sec.21 of the Bonded Labour System (Abolition) Act, 1976, the Revenue Divisional Officers / Sub Collectors are designated as the Bonded Labour Releasing and Rehabilitation Officers.  To ensure effective implementation of this Act, the District Collectors are also made responsible for the release and rehabilitation programmes.

            A State Level Monitoring Committee has also been constituted headed by the Chief Secretary to monitor the progress made by the District Level Committees to identify, release and to rehabilitate the freed bonded labourers. (Vide G.O.(Ms) No.79, Adi Dravidar and Tribal Welfare Department, Dated 17.09.2002). For the year 2013-14, a sum of Rs.66.81 lakhs was spent and 965 were benefited.

COMMUNITY CERTIFICATES

 Issue of Community Certificates

Community Certificates to SC/ST are issued by the Revenue Authorities viz. Tahsildars / Revenue Divisional Officers (RDOs) respectively. Since 1989, the power to issue Community Certificates to Scheduled Tribes has been delegated to the RDOs concerned. In order to help the SC/ST people, the State Government has constituted committees at the District and the State level as advised by the Supreme Court of India. An Anthropologist has also been included in the Committees as one of the members. The genuineness of community certificates issued by the Tahsildars and Revenue Divisional Officers are verified by these above committees as constituted in G.O(2D) No.108, Adi Dravidar & Tribal Welfare Department, dated:12.09.2007.

RULE OF RESERVATION

Rule of Reservation for Adi Dravidars and Tribals

            Among the Adi-Dravidars, the Arunthathiars are still at the lowest rung in terms of their socio-economic and educational status. In order to provide special concessions to them for their social upliftment, an Act viz. The Tamilnadu Arunthathiyars (Special Reservation of seats in Educational Institutions including Private Educational Institutions and of appointments or posts in the Services under the State within the Reservation for the Scheduled Castes) Act.4/2009 (Tamilnadu Act 4 of 2009) has been enacted offering 3% reservation to Arunthathiars within the 18% reservation available for the Adi Dravidars and brought into force from 29.4.2009. During this academic year 2013-14 by the Recruitment appointed through under this Act, 520 Arunthathiyars have been admitted in Medical courses, 1964 Arunthathiyar students in Polytechnic Courses and 3235 Arunthathiyar are admitted in Engineering courses. As per the letter (107/A1/2013) from the The Teachers Recruitment Board Member Secretary letter dated. 07.01.2014, it has been reported that during the academic year 2013-14 the total number of post was 4756. Out of which reservation for SCA, SC, ST were 157, 730, 81 respectively. 307 Arunthathiyars were appointed through Tamilnadu Public Service Commission and 511 Arunthathiyars were appointed through Employment Training.

Following steps have been taken to ensure effective implementation of rule of reservation in the appointments.

$1Ø  Filling up of backlog reserved vacancies through special recruitment.

$1Ø  Appointment of a Nodal Officer to supervise the proper implementation of reservation policy in all the departments.

$1Ø  Nomination of at least one Member belonging to the Adi Dravidar / Tribal in the Selection Committee.

$1Ø  Appointment by direct recruitment where the representation of SCs/STs is less than 19%.  Such recruitment shall be in each category viz. Group A,B,C and D.

$1Ø  Indicating at the lowest entry level the number of Scheduled Caste vacancies while calling for estimate of vacancies.

$1Ø  General instructions to be followed for admission to professional courses.

Pradhan Manthri Adarsh Gram Yojana Scheme (PMAGY)

            The Government of India has introduced a new pilot scheme namely PMAGY for implementing integrated development programmes in the villages that are having more than 50% of the Scheduled Castes Population. Now 225 villages in Thiruvarur and Cuddalore Districts have been selected and a sum of Rs.20.00 lakhs for each will be is given for providing infrastructures facilities.

The State Government has constituted the State Advisory Committee and State Level Steering-cum-Monitoring Committee for monitoring the Schemes.

 The Government of India has sanctioned a sum of Rs.4522.50 lakhs for the Socio-Economic upliftment of the Adi Dravidar people and to improve the infrastructure needs in their habitations in the above said 225 villages.
